§ 1. Organiser
Club events are organised by True Divers Janusz Czachor, ul. Doktora Judyma 5A, 47-232 Kędzierzyn-Koźle, Poland, tax ID (NIP) 7491951233, REGON 160355839.
For anything to do with bookings: info@truedivers.net, +48 785 00 25 00.
§ 2. The club and your account
Club membership is free. You create an account with an e-mail address and sign in through a link sent to it — there is no password.
Your profile holds what the staff need to build a list: name, certification, emergency contact and gear sizes. Only the name is required.
You can close the account at any time by writing to the address in § 1. Closing it does not undo bookings for events that have already taken place, nor any settlements.
§ 3. Booking and places
You book through the club pages. When you book you tick the gear you need from the rental store and give your sizes.
Where an event has a limited number of places, they go in the order people book — and for events with a deposit, in the order the deposits arrive.
Booking forms a contract to take part on the terms shown with that event: date, price, deposit and the free-cancellation deadline.
§ 4. Deposit and payment
Some events hold your place with a deposit. The amount is shown with the event and before you pay.
Deposits are paid by card or BLIK through the payment provider Stripe. We do not store card details.
The deposit counts towards the price. The balance is settled before the event starts, in the way stated with that event.
We issue an invoice for a paid event on request — just write to the address in § 1.
§ 5. If you cancel
Every event states a free-cancellation deadline. By default it is 48 hours before the meeting time; longer trips may set it earlier, and then it is stated explicitly.
Cancel before that deadline and it costs nothing. The whole deposit goes back to the card you paid with.
After that deadline we keep the amount or the percentage of the price stated with the event. The reason is practical rather than punitive: by then the gear is packed, the cylinders are filled and the places have been paid for.
What we keep never exceeds what you actually paid — we do not charge your card after the fact. If the cancellation fee is higher than the deposit, we settle the difference with you individually.
Cancel through the club pages or by e-mail to the address in § 1. What counts is the moment your cancellation reaches us.
You may also pass your place to someone else who meets the requirements in § 7. In that case we keep nothing.
Refunds go back the way the payment came, within 14 days of the cancellation.
This section does not cover package holidays — trips combining at least two services, such as a flight and accommodation. There the Act and § 10 govern cancellation, and the thresholds shown with the event are informational only.
§ 6. Why there is no 14-day withdrawal here
The 14-day right of withdrawal from a distance contract does not apply to taking part in an event held on a set date. This follows from art. 38 pkt 12 of the Polish Consumer Rights Act, which excludes leisure and sporting services where the contract names the day or period of performance.
What applies instead is § 5: the free-cancellation deadline shown with every event. That window is the only one you have, which is why we show it when you book and when you pay, rather than only in the confirmation.
Buying gear in the shop is a different contract, and there the 14 days apply as usual — the terms of sale set that out.
§ 7. Gear, sizes and qualifications
We reserve rental gear from what you tick when you book. You can change sizes up to the free-cancellation deadline — after that the gear is packed.
Gear comes back complete and working. Damage beyond normal wear is the participant’s responsibility.
You may take part if you hold certification appropriate to the dives planned and are in a fit state to dive. Participants declare this before diving; we do not collect medical records.
The dive leader may stop anyone from diving if their condition, gear or certification raises doubts. That is not a participant cancellation under § 5, and we settle it case by case.
Dive insurance is up to the participant. For trips abroad we state with the event whether it is compulsory.
§ 8. If we cancel
We may cancel an event when conditions are unsafe or the minimum number of participants stated at booking is not reached.
If that happens we refund everything you paid, or move it to another date if you prefer. The choice is yours.
We do not refund costs we never charged: your own travel, flights booked separately, or accommodation arranged outside the club.
§ 9. Complaints
Complaints about an event go to info@truedivers.net or by post to the address in § 1. We answer within 14 days.
A consumer may also turn to the local consumer ombudsman (powiatowy rzecznik konsumentów) or the regional Trade Inspection authority.
§ 10. Trips abroad
A trip that combines at least two services — a flight and accommodation, say — is a package holiday under the Polish Package Travel Act of 24 November 2017. What settles that is what the trip contains, not what it is called.
Not every trip abroad we run is a package holiday. If what you buy from us is the diving alone — instructor supervision, gear, a place on the boat — and you arrange the flight and the accommodation yourself, the contract covers the diving only. Every trip states which of the two it is, because your rights follow from that.
Insurance you buy yourself is not a travel service under the Act and does not change how the trip is classified. Who bought it therefore says nothing about whether the trip is a package holiday.
Where the club is the organiser, we are liable for the performance of every service in the package — including those carried out by the carrier, the boat operator or the hotel (art. 48 of the Act). How we divide the work and the accounts with our suppliers is our business and does not change who answers to you.
Every such trip states who the organiser is. Where it is a travel agency we work with, your contract is with the agency and its own terms apply; the club gathers the group, runs the diving and supplies the gear.
Where the club is the organiser, the trip states our entry number in the register of tour organisers and the details of the financial guarantee protecting your payments. Nobody in Poland may sell package holidays without both, and the guarantee is what returns your money if the organiser fails.
Before the contract is made you receive the standard information form and the terms of participation. A package-holiday booking is not complete without them.
Cancelling a package holiday follows its own rules, and they take precedence over § 5. You may withdraw at any time before the trip starts; the organiser may charge an appropriate and justified termination fee and, at your request, must justify its amount (art. 47(2) and (3) of the Act). The 48-hour threshold in § 5 does not apply.
If unavoidable and extraordinary circumstances arise at the destination or nearby that significantly affect the trip or the journey to it, withdrawal is free and everything paid comes back in full within 14 days of the contract ending (art. 47(4) and (6)). No further compensation is due in that case.
A deposit paid through the club pages then counts towards that contract and follows the same rules.
§ 11. Personal data
The data controller is the entity named in § 1. We process profile and booking data in order to run the event and settle up.
Consent to our mailing is separate from membership, voluntary, and can be withdrawn in your profile at any time. Details are in the privacy policy.
§ 12. Changes to these terms
We may change these terms going forward. An event you have already booked is governed by the wording in force on the day you booked.
Anything not covered here is governed by Polish law, including the Civil Code and the Consumer Rights Act.
