§ 1. Seller
The online shop at truedivers.net is operated by True Divers Janusz Czachor, ul. Doktora Judyma 5A, 47-232 Kędzierzyn-Koźle, Poland, tax ID (NIP) 7491951233, REGON 160355839, registered in the Polish Central Register of Business Activity (CEIDG).
Contact: e-mail info@truedivers.net, phone +48 785 00 25 00 during opening hours, or by post to the address above.
§ 2. Who is who
- Consumer — a natural person buying for purposes unrelated to their business.
- Sole trader with consumer rights — a sole proprietor buying for purposes outside their professional activity. Has the same withdrawal and complaint rights as a consumer.
- Customer — anyone placing an order, including a business buying for its own use.
- Made-to-measure gear — an item produced to measurements or specifications supplied by the Customer, for example a made-to-measure drysuit. It is clearly marked as such on the product page.
§ 3. Ordering and conclusion of the contract
Using the shop requires a web browser with JavaScript enabled and an e-mail address.
The Customer adds products to the cart, proceeds to payment handled by Stripe, provides delivery details and chooses the delivery and payment method. The total amount including delivery is shown before payment.
The sales contract is concluded when the payment is confirmed. The Customer receives an order confirmation at the e-mail address provided.
The lead time is stated on each product page and runs from payment confirmation. For made-to-measure gear it includes measurement at the centre and production.
If, after the order is placed, the product turns out to be unavailable from the distributor, the Seller informs the Customer without delay and refunds the full amount paid.
§ 4. Prices and payment
Prices are in Polish złoty and include VAT. They do not include delivery, which is shown separately before payment.
Signed-in club members see the club price where one has been set; it is applied automatically at checkout.
Payment is made in advance through the payment operator Stripe: by card, BLIK or Przelewy24 bank transfer. The Seller does not store card details.
An invoice is issued for every order and sent by e-mail. Business customers provide their tax ID at checkout.
§ 5. Delivery
We ship within Poland and to European Union countries. Available delivery methods and their cost are shown at checkout, before the order is placed.
- Courier within Poland — 25 PLN, 1–3 working days from dispatch.
- InPost parcel locker — 20 PLN, 1–3 working days from dispatch.
- Collection at the centre in Kędzierzyn-Koźle — free of charge.
- Courier to EU countries — 60 PLN, 3–7 working days from dispatch.
Diving cylinders, as pressure vessels, may require separately priced transport; the Seller agrees it with the Customer before dispatch.
It is worth checking the parcel for damage on receipt. A damage report drawn up with the courier makes a complaint easier to process, but is not a condition of making one.
§ 6. Right of withdrawal
A consumer or a sole trader with consumer rights may withdraw from the contract without giving a reason within 14 days of receiving the goods (art. 27 of the Polish Consumer Rights Act).
To withdraw, it is enough to send a statement by e-mail or post before the deadline. The form at the end of these terms may be used, but is not compulsory.
The goods must be returned to the Seller's address within 14 days of the statement. The Customer bears the cost of the return (art. 34(2)).
The Seller refunds all payments received, including the cost of the cheapest delivery offered, within 14 days of receiving the statement. The refund may be withheld until the goods or proof of their dispatch are received (art. 32).
The Customer is liable for any reduction in the value of the goods resulting from use beyond what is necessary to establish their nature, characteristics and functioning (art. 34(4)). Gear that has been used underwater is no longer new — in that case the refund is reduced accordingly.
The right of withdrawal does not apply to made-to-measure gear, i.e. a non-prefabricated item produced to the Customer's specifications or clearly personalised (art. 38(3)). This applies only to products marked on the product page as made to measure. Ordering a catalogue item in from a distributor is not making it to measure and does not exclude the right of withdrawal.
The right of withdrawal does not apply to a Customer buying for the purposes of their business, unless they are a sole trader with consumer rights.
§ 7. Complaints
The Seller is liable to a Consumer for the goods' non-conformity with the contract revealed within two years of delivery (chapter 5a of the Consumer Rights Act). For businesses the warranty provisions of the Polish Civil Code apply.
A complaint may be made by e-mail or post, describing the defect and quoting the order number. The Seller responds within 14 days. No response within that time means the complaint is accepted.
The Consumer may demand repair or replacement. If that is impossible or would involve excessive cost, or if the defect is material or the Seller has not remedied it within a reasonable time, the Consumer may demand a price reduction or withdraw from the contract.
The Seller bears the cost of delivering the goods under complaint to the Seller and back.
Independently of the above, the manufacturer may provide its own guarantee; its terms are in the guarantee document supplied with the product.
§ 8. Out-of-court dispute resolution
A consumer may seek free assistance from the district or municipal consumer ombudsman or from a consumer organisation.
A consumer may also apply for out-of-court dispute resolution to the Provincial Trade Inspectorate in Opole. Information on the procedure is available at uokik.gov.pl.
Using these options is voluntary and does not preclude court proceedings.
§ 9. Personal data
The data controller is the Seller. The rules for processing data are set out in the Privacy Policy.
§ 10. Final provisions
These terms apply from 8 September 2026. Changes to the terms do not affect orders placed before they take effect.
Matters not covered here are governed by Polish law, in particular the Consumer Rights Act and the Civil Code. Nothing in these terms excludes or limits rights that a Consumer has under mandatory provisions of law.
The Polish version of these terms is binding. The English version is for information only.
